Backyard Fun For Kids Shipping Terms & Agreements:

Many of the products available on this website are delivered via a freight carrier (swing sets, playhouses, some playset add-ons). These type of deliveries require a delivery appointment to assist with the unloading of goods, along with inspecting and signing for the delivery. When the shipment arrives near your location, you will be contacted by the carrier to arrange a delivery appointment. While the carrier may allow some flexibility in appointment times, lengthy delays in appointments may result in storage fees. Backyard Fun For Kids is not responsible for such fees.

The carrier will deliver as close to your property line (curbside) as is accessible to the vehicle. Swing set deliveries will include liftgate services to assist with offloading the pallet from the truck. The driver is under no obligation to assist with the unloading of the shipment; therefore, it is recommended that your have one or more assistants to help unload the delivery. While the total weight of such products may be very heavy, the product is divided into boxes that are more manageable by 1-2 people. In a case of a delivery that does not include liftgate service, you will be given a reasonable amount of time to complete the offloading of the shipment, typically 15-30 minutes.

It is very import that you thoroughly inspect the delivery and document ANY damage that you see on the bill of lading/delivery receipt that you sign. Failure to document such findings may result in delays or even the inability to resolve such claims.

Freight services are prepaid, and no additional charges should be presented to you at the time of delivery. However, you may request additional services of the carrier (two-man delivery, inside delivery, lift gate, or address change) once the carrier contacts you. These services may involve additional charges, and are not the responsibility of Backyard Fun For Kids.

Backyard Fun For Kids will not accept unauthorized returns. If you need to return an item, please contact us prior to doing so. If conditions for the product return as stated below are met, we will issue you a return authorization number (RA #) that must be marked on your return package. With the exception of returns caused by our error, shipping costs for returned items will be buyer's responsibility as well as the original shipping charge and a 10% restocking fee. No return will be accepted without invoice number or date of sale. To receive a refund or credit, returned items must be in original packaging, unused, in original condition and received by Backyard Fun For Kids within 10 days of your original receipt of the product. Items will be inspected prior to issuance of any refund or credit.

Order Receipt Process:

Shipper will call the customer for a date to deliver the shipment.

Someone must be present upon delivery of products.

Shipping company will not leave the product unless someone is present to sign for it.

It is recommended that the customer have 2-3 persons to assist in unloading the shipment.

Recipient must inspect all shipments thoroughly upon receipt.

Recipient must note any damage on the delivery receipt and also have the driver acknowledge the same.

Customer must keep all the packaging of/and the damaged goods until the claim is resolved.

Backyard Fun For Kids reserves the right to require pictures to document the damage and substantiate a claim to the motor carrier.

Good documentation and digital pictures are the quickest way to get any replacement parts to the customer.

Customer must notify Backyard Fun For Kids within 3 business days of receiving a shipment with damages.

IMPORTANT – DO NOT REFUSE THE SHIPMENT.

Refused shipments will result in additional charges to the customer.

Order Cancellations:

If order is cancelled after it has been shipped or/Return is approved to be made within 14 days of the original shipment date:

•Refund of the order will be sent to the customer minus a 20% restocking fee.

•Return shipping is the responsibility of the customer.

•Orders made with “shipping charges included” will have those shipping charges taken out of Order refund amount in the instance of a cancellation of the order.

For All Delivery Types (UPS/LTL CARRIERS):

Backyard Fun For Kids is not responsible for deliveries that are misdirected due to an incorrect shipping address, including any fees incurred from misdirected deliveries. If a shipment cannot be delivered successfully as a result of invalid shipping address, or if no one is available to accept/sign for the delivery after an extended period of time, the carrier may need to return the shipment to our warehouse. If this should occur, after a reasonable attempt has been made to make these arrangements with the recipient, a refund for the purchase will be provided, minus shipping fees.

While Backyard Fun For Kids works closely with its carriers to assure timely shipment of your order, delivery times are NOT guaranteed, and various factors can impact the carrier's ability to deliver within the expected time frame. These factors include:

• your location in relation to our warehouse

• the carrier

• holidays

• weather

• other unforeseen events that may delay shipping time

Backyard Fun For Kids' $49 swing set delivery offer is good for a standard delivery (no rush deliveries), and is available ONLY in the lower 48 states. Deliveries refused, including those due to late deliveries on the carrier's behalf will be refunded minus all incurred shipping costs, which may included, but is not limited to, shipping costs to and from the respective delivery address.

Returns

Returns are allowed within 14 days of original ship date as long as items are in the original packaging, the item is unused, and the item is in resalable condition. Upon receipt of goods that we deem resalable, Backyard Fun For Kids will credit the customer for the total purchase price less return the freight costs as well as the original outbound freight costs if the product was shipped prepaid. Backyard Fun For Kids reserves the right to deviate from this return policy on a case-by-case basis at its sole and absolute discretion.
